| I have been selling my own things on ebay, but want to start purchasing items wholesale to sell, thus I need either a business license or re-sale permit license, is that correct? Does anyone know how much that costs...and can I have a business license even though the business is in my house selling on ebay? So I own a store where I sell retail clothing in Florida. Recently I have decided to open an ebay store and sell some of my items. Is it okay to use my federal tax id of my store, or do I have to get a new one? To do what you want, you need file two permits. One because of location, the other because of purpose.

| The key here is the Sellers Permit. It allows you to purchase wholesale virtually any item, so long as that purchase is intended for resale. It is blind to any other detail, and as such, allows you to use a sellers permit originally used to operate let's say, a restuarant, to obtain high gauge steel if you want, as long as you follow through with reselling it in a legal manner, charge sales tax, and pay your dues to the state. The problem is that you can't use your Business License in the same manner. A Business License applies exactly as the application spells it out. It can not be used to license another location or purpose, no matter the reason or justification.Simply put, to operate your E-Bay business legally, it is imperitave that you obtain a new and seperate business license and most likely Home Occupation License as well. |

You can use it to cover multiple business operations, but only if they are licensed properly. 2. The difficulty arrives in that business licenses are non transferable. Not only are they bound to a specific business, they are bound to a specific location. Even if the same business opens a new branch, it will need a new license. |

| Without a sellers permit, you simply can't purchase wholesale. Why? Because to purchase wholesale, you must file with the wholesaler an official Resale Certificate, and in big bold letter, usually towards the top of this certificate, you are required to enter the ID number you are issued when you file for you Sellers Permit. Now there simply doesn't exist anywhere a wholesaler that will sell to a resaler that can't provide them with that document. It is quite literally as simple as that. Now why do you need another Business License you may be asking? Well that is also fairly straightforward. An unlicensed business is a business that is neither registered for taxes, nor certified by the local government as legal to operate in it's location and form. Without the first, you are subject to fines, penalties, audits, and misdemeanor charges. Without the second, you are subject to outright police enforced closure. |
